Although the law might have been used successfully to ban obscene speech and probably could successfully ban hate speech,I wouldn't want to give the government that power.Nazi Germany existed only fifty years ago and judging by the comments left on youtube,racism is alive in America granted most racist probably don't belong to hate groups. I just wouldn't want to give someone like David Duke or Adolf Hitler that authority.

If the law has been used successfully to ban obscene speech, then there should not be a problem applying a similar law to racist speech. The only issue is that America is still a very racist country. This is an issue of racism and one persons right to spew hatred, fear and intimidation on an innocent person under the guise of free speech. If that's what you defend then so be it, just be honest about it.

what a joke. you're talking about applying ambigious terms with scientific precision- that's impossible. what is your definition of something w/ "artistic value?" (or "political" or "scientific" value for that matter). you can't define it b/c it varies from person to person. it's simple, if it offends you don't listen, turn off the source. better to let 100 Daniel Carvers speak out than to silence 1 rational person who's valid view is snuffed out b/c it's not deemed "artistic" enough

Yes, and I believe that laws that prohibit me from telling people to go and riot are wrong. I know that sounds crazy, but as adult's we cant blame people for telling others to do something, rather we must blame the people behind the act.
But please answer my question. What would you have done to stop hate speech. Im just curious. And how would you decide whats hate speech and whats morally acceptable to say and not say?

You fail to realize that certain speech is already banned. Supreme Court doctrine already bans speech that incites direct violence (i.e. if a speaker tells people they must go out and cause a riot). What is interesting is not the law, but how it is implemented in society. Rarely have white supremacist race groups faced such laws. Instead, such laws were applied to people like Malcolm X and other civil rights leaders. This says a lot about American society and the values it holds.

Okay, very interesting point you make.
So, what would you like to have done about racists speech? Make a law that people cant use certain words?
If so, where would it end? And how many people does it take for a word to be declared "racist" or "hateful"?
I dont know about you, but I really dont want the government controlling what words I or you can use.
